Nigeria’s Technology Laws Enter New Era as EandC Legal Unveils 2026 Report

EandC Legal, a Nigerian startup and commercial law firm, has released the Nigerian Technology Law Report 2026, a publication examining how Nigerian courts are responding to legal challenges created by the country’s rapidly expanding digital economy.

The inaugural report contains 10 court judgments covering key areas including electronic contracts, data protection, intellectual property and technology transfer.

According to the firm, the publication provides a structured record of cases in which technology played a significant role in the legal questions considered by the courts.

The report comes at a time when technology is increasingly influencing sectors such as banking, financial services, healthcare, commerce, entertainment, intellectual property and government services.

The growth of fintech platforms, digital marketplaces, artificial intelligence, data-driven businesses and other technology-based services has also created new commercial relationships and regulatory challenges.

The Editor-in-Chief and Lead Partner of EandC Legal, Omoruyi Edoigiawerie, said technology law could no longer be regarded as a narrow or specialised area of legal practice because technological issues now cut across almost every field of law.

He explained that a case should not necessarily be classified as a technology law matter simply because it was filed under a technology-related statute.

Instead, the focus should be on whether technology materially affects an important legal issue that the court is required to determine.

Edoigiawerie said the report therefore adopted a functional approach designed to identify technology-related issues even when they arise in conventional disputes.

He noted that commercial disputes could involve technology law questions when courts are required to determine the validity or evidential value of electronically generated records.

Similarly, banking cases involving electronic transfers and digital platforms may raise important technology-related legal questions.

Intellectual property disputes can also involve technology, particularly where protected rights are being technologically exploited, transferred or commercialised.

According to EandC Legal, this broader approach offers a clearer picture of how the Nigerian judiciary is responding to technological developments by bringing together cases from different areas of law in which technology has materially influenced the issues before the courts.

The report also highlighted the growing importance of the judiciary as lawmakers and regulators attempt to keep pace with rapidly developing technologies.

Edoigiawerie said technological advancement often moves faster than legislation, meaning courts are increasingly required to apply existing legal principles to technologies that may not have been contemplated when relevant laws were enacted.

The report is expected to monitor emerging judicial principles involving digital evidence, electronic transactions, data protection, artificial intelligence, digital assets, cybersecurity, platform liability and technology-driven intellectual property disputes.

EandC Legal said the publication would serve as a research resource for lawyers and academics while providing policymakers, regulators and businesses with useful insight into judicial interpretations affecting Nigeria’s technology ecosystem.

The firm also noted that technology-related judgments are often scattered across traditional areas of law, including commercial law, banking, evidence and intellectual property.

The new report seeks to consolidate such decisions and provide a clearer record of how Nigerian courts are shaping the legal framework for the country’s digital economy.

The first edition of the Nigerian Technology Law Report 2026 is available through the report’s official platform and is expected to form the foundation for an expanding record of judicial decisions influencing Nigeria’s evolving technology law landscape.
