The U.S. Supreme Court has directed the government to take steps to return Kilmar Armando Abrego Garcia, a Salvadoran immigrant, who was mistakenly deported to a prison camp in El Salvador.

While the Supreme Court did not explicitly order his repatriation, it upheld part of a lower court’s decision requiring the government to “facilitate and effectuate the return” of Garcia.

However, the Court also noted uncertainty over the intended scope of the term “effectuate,” which may exceed the trial court’s authority.

The Court stated, “The intended scope of the term ‘effectuate’ in the district court’s order is, however, unclear, and may exceed the district court’s authority.”

Judge Paula Xinis of the Federal District Court in Maryland had earlier ordered Mr. Garcia’s return by Monday, after the mistake was acknowledged.

The Trump administration had appealed to the Supreme Court, arguing that facilitating Garcia’s return might be difficult.

A Department of Justice spokesperson emphasized that foreign policy decisions fall under the president’s exclusive authority, stating, “As the Supreme Court correctly recognised, it is the exclusive prerogative of the president to conduct foreign affairs. By directly noting the deference owed to the executive branch, this ruling once again illustrates that activist judges do not have the jurisdiction to seize control of the president’s authority to conduct foreign policy.”

Meanwhile, Garcia’s lawyer, Andrew Rossman, celebrated the decision, stating, “The rule of law won today. Time to bring him home.”
